Resistance in the Courts

Judges faced with citizen lawsuits challenging the Trump usurpation of Constitutional powers who are inclined to rule against plaintiffs on standing issues need to ask themselves this question: If this court does not have the ability to consider and rule on grossly unconstitutional behavior on the part of the executive, how will that abuse of power be addressed? And if it goes unaddressed, is that not a systemic failure of constitutional governance? 

The Constitution and the rules of courts must be interpreted as allowing courts to take action to preserve the Constitution itself. 

Otherwise there will be no mechanism to prevent a totalitarian takeover. Americans must be prepared to resist this with every means at their disposal. It is the duty of judicial officers to preserve, protect, and defend the Constitution. Time to step up.
